Emergency works can be undertaken on a listed building without prior consent if they are urgently necessary for the building's safety, health, or preservation.
The emergency works must be limited to the minimum measures immediately required, and it should not have been practical to ensure public safety and health or preserve the building through repair or temporary support. Additionally, written notice justifying the emergency works must be provided to the Local Planning Authority as soon as reasonably practicable.
Failure to prove all these mitigating circumstances may lead to prosecution for carrying out unauthorised works.
